Restaurant sued for employment law violations and harassment

In California and across the nation, there is an unfounded perception that sexual harassment is generally limited to males harassing females. However, this is not the case. Sexual harassment can come in any combination of genders and even occur when a person witnesses it happening to others. For anyone who is subjected to sexual harassment, it is a violation of employment law. Understanding how to pursue compensation for violations including sexual harassment, retaliation, wrongful termination and more is key to a case.

The restaurant chain, Chipotle, was sued by the U.S. Equal Employment Opportunity Commission because of a female manager allegedly sexually harassing a male employee. After the male employee complained, he allegedly faced retaliation. The male, 22, was allegedly transferred from one restaurant location to another in 2015. When he arrived at the new job, he is said to have been allegedly subjected to comments of a sexual nature. The manager allegedly propositioned him and allegedly touched him on various parts of his body in an inappropriate manner.

There were other alleged behaviors that took place including the woman having a "scoreboard" for sexual purposes and asking the complainant and others to say whether they engaged in relations the night before. The manager also allegedly made comments about wanting to watch the male have intercourse with his girlfriend and join them. The male complained in the autumn of 2015, but the alleged behavior went on. He claims that he was also mistreated by fellow employees by being allegedly locked in a freezer and having his motorcycle moved without his knowledge. He subsequently quit. He seeks lost pay and punitive damages.

Those of any age, gender and type of employment should know that they have the right to be treated according to the law by employers and fellow employees. Sexual harassment can happen to anyone and can negatively affect a person in a myriad of ways. When there is retaliation along with the harassment, it is a very difficult situation to overcome.
