Woman Claims Violations of California Workplace Harassment Laws

California-Workplace-Harassment-Laws-.jpgSouthern California has a wide range of jobs from labor to white collar. While the duties that are inherent in these jobs are as diverse as the people who do them, sexual harassment allegations can happen in any type of employment. People who are being subjected to sexual harassment must be aware that they can object to the treatment. If they face any kind of punitive measures due to their complaint, they can seek to receive compensation for this violation of employment law.

A woman who worked at Morgan Stanley has filed a lawsuit claiming that she was dismissed from her job because she complained about being sexually harassed at work. The former financial adviser says that a manager asked her for sexually explicit images of herself. She asserts that the behavior was prevalent. In the claim, she alleges sexual harassment, wrongful termination, sex discrimination, a failure to prevent harassment, retaliation, and discrimination. For its part, the company proclaims that it adhered to the law.

The former employee says that she was hired in September 2012. She was one of the few females in her specific department and found herself facing sexual harassment. She was propositioned and demeaned. The lawsuit also says that the company is responsible because it did not adequately train management to prevent these behaviors. When the woman lodged a complaint about how a manager was harassing her, she was taken from all shared client accounts. This manager is accused of inappropriate acts, touching and trying to kiss her. The man who had requested the photos had previously asked the woman to join his team but rescinded the offer after she complained. She was then transferred to another location, but the behavior continued.

Having one's work life sabotaged and damaged because of complaints about inappropriate behavior sounds like something that might have happened in the distant past. However, it is still going on and people are negatively affected in their personal and professional life because of it. When sexual harassment takes place, the person who is being mistreated must be aware of their alternatives under employment law. Compensation can be achieved by filing a lawsuit. Discussing a case with an experienced attorney is the first step to moving forward.
