Last month, I was the lead chair in a civil trial. I had worked weekends and nights leading up to trial. (For those not in the legal profession, most cases don't go to trial. Approximately 95% of lawsuits settle prior to trial because of the costs involved- whether it's monetary, time consumption, or emotionally wearing.) But here I was, exhausted and a bit nervous, but ready to fight the good fight. The trial was up and down. One day, everything appeared to be in our favor. The next, the other side appeared to be winning. All in all, a very stressful time. And, for those of you wondering, trial is not set to complete until December!

So, you ask: Why? Why are you a lawyer? Why would you put yourself through this? The answer is simple: The clients. I believe in my clients. When they've been wronged-whether it's on the side of the plaintiff or the defense-I want to work hard to make sure that fairness prevails.

For this Thanksgiving, I want to say a big thank you to all my current and past clients. Thank you for your trust in me and your trust in JLG.

Understanding Sexual Harassment in the Workplace


Sexual harassment in the workplace in California is a persistent problem. However, many people may be unaware whether there has been a violation of state employment laws. There are two different kinds of sexual harassment in the workplace. It is crucial to understand what they are so the appropriate steps can be taken to put a stop to the behavior or, if necessary, file suit.

If there is a request for sexual favors or the harassment is expected to be accepted without complaint in exchange for something, it is known as "quid pro quo." This is Latin for "this for that." If, for example, a person asks another employee for sexual favors in exchange for a promotion, to keep a job, to be granted a job, or another kind of benefit, it is illegal and will fall into the category of quid pro quo. The second kind of harassment is if there is a hostile work environment. This happens if there are comments or behaviors in the workplace and the victim is hindered by such comments or behavior. This can lead to hostility, intimidation, or being offended at work. It is important
to remember that it does not necessarily have to be the person to whom the behavior was directed who files a complaint. Simply being nearby and witnessing the behavior may fall under the protections of state employment laws.

To be unlawful, the sexual harassment must be severe or pervasive. By that, it means that the behavior is altering the conditions of employment and leads to an abusive work environment. It does not have to be repeated to be considered against the law. It can happen once and if it is severe or pervasive, that is sufficient for a complaint.
