Domestic Violence and Support

In divorce, a history of domestic violence in a relationship can have significant impact on not only custody arrangements for minor children, but also on spousal support orders.

Family Code section 4325 states in part that where there is a criminal conviction for domestic violence by one spouse against the other within 5 years of filing of the divorce proceedings, there is a presumption that the abused spouse should not have to pay the abusive spouse spousal support.

The Court may consider evidence of the convicted spouse being a victim of domestic violence at the hands of the other spouse.


Bankruptcy On The Rise

Bankruptcy filings are on the rise, according to statistics released by Epiq Systems, Inc. Commercial bankruptcy filings increased by 26% in 2016.

Early indicators suggest that 2017 may continue this trend-nationwide bankruptcy filings increased by 4% in March 2017, compared with the same period in 2016.


Death Of The Estate Tax

In April 2017, the White House proposed eliminating the federal estate tax, also known as the "death tax" as part of its tax reform.

Currently, the estate tax imposes a top rate of 40% on transfers exceeding $5,490,000 per person made at death. California in response is proposing to create a similar estate tax at the state level in the event that the federal estate tax is repealed.

California's Wage Orders created by the Industrial Welfare Commission (IWC) govern employees' Welfare Commission (IWC) govern employees' wages, hours, and working conditions in various industries and occupations.

One often overlooked requirement of almost all of these wage orders is to provide suitable seats for employees. This means that, depending on the nature of the employees' work, employers are required to provide adequate seats/chairs to perform their tasks and/or have seating available for rest breaks where the nature of the work does not ordinarily allow for sitting.
