We just celebrated JLG's 8th anniversary! It wasn't so long ago that JLG (then "The Law Office of Michael J. Jaurigue") was run out of a 150 square foot office. In the first 5 years, we saved over a thousand homes through loan modifications and bankruptcy repayment and restructuring plans. Many clients, business associates, and friends have been loyal supporters of JLG, referring us more clients and coming back to JLG for other legal services. I just want to say a heartfelt "thank you!"; without you, JLG could not have grown to where it is today.

Most of you know that JLG now provides multiple services through 7 attorneys with offices in Glendale, San Jose, and San Francisco. We have an incredible team of attorneys who graduated from top law schools (Berkeley, UCLA, USC), several of whom have been recognized as Rising Stars by Super Lawyers and Top Attorneys in their local areas. Our lawyers are properly trained, mentored, and get better results. Did You Know

In order to file for a dissolution of marriage in California, one of the parties must have been a resident of California for six months and lived in the county in which the Petition is filed for three months prior to filing the Petition. Cal. Fam. Code § 2320(a).

However, domestic partners who registered their partnership with the California Secretary of State and those married individuals seeking legal separation have no domicile or minimum residence requirement in filing for dissolution of
the partnership. Many individuals may elect to first file for legal separation and then amend their Petition to file for dissolution of marriage when they are unable to immediately satisfy the residency requirements for dissolution of marriage.


TCPA Recap and Recent Settlement

The Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. Section 227, restricts telemarketing through the use of automated telephone equipment including automated dialing systems, artificial or prerecorded voice messages, SMS text messages, and fax machines. Common violations of the TCPA may include (1) autodialed and/or prerecorded calls and text messages and (2) unsolicited fax advertisements without prior express written consent.

Some prominent TCPA class actions settled in 2016 include:

  • $18 million class settlement against Portfolio Recovery Associates for making autodialed calls to consumer cell phones for the purpose of debt collection.
  • $1.5 million class settlement against First Arkansas Bank & Trust and Dental Equities LLC for faxed advertisements for the "Doctors Club" credit card because Defendants' lacked prior express consent and failed to include an opt-out notice with the fax.
  • $3 million class settlement in cash or company credits against Guess Inc. for unwanted text messages.

Beware of W-2 Scams

With tax season upon us, the taxing agencies issued an urgent alert concerning employers falling victim to Form W-2 email phishing scams. To minimize the risk of being a victim to these types of scams, taxpayers should try to file their 2016 tax returns as soon as possible.

California Car-Seat Law

Effective January 1, 2017, children under the age of 2 must be rear-facing in the car unless they weigh 40 lbs. or more, or are 40 inches or more.

Previously, parents were only strongly encouraged to leave their child's car seat rear-facing until the age of 2. The penalty for failing to comply is $500 and a point on one's driver's license.

Parents we urge you to take the necessary precautions to keep your child safe.
